Pawnbrokers and Second-hand Dealers Act 1994 and Regulations 1996

Section 15 of the Pawnbrokers and Second-hand Dealers Act 1994 relates to the renewal of a licence and states inter alia that:

  1. an application for the renewal of a licence is to be –

    • made in an approved form lodged at, or sent by post to, a place approved by the Commissioner; (in the metropolitan area Police Licensing Services or in the country at the local Police Station) and
    • Accompanied by the prescribed fee.
       
  2. an application for the renewal of a Licence is to be made no later than 28 days before the day on which the licence is due to expire.

NOTE: Applications for renewal that are not submitted in accordance with the requirements of the Act, will not be accepted.

Where a licence expires and a person or company continues trading in second-hand goods they are liable to prosecution under the Act.

Penalty for an individual: $5,000 and 12 months’ imprisonment.
Penalty for a body corporate: $20,000
